Believe it or not, in Georgia, many traffic violations–including things like speeding–are considered misdemeanors and are punishable with up to 12 months in jail and/or $1,000 in fines! Direct consequences of traffic violations can include license suspension and points on your driver’s license. Collateral consequences include increased insurance fees. In Georgia, there is an old saying that it is harder for the State to prove a speeding than a murder case. This is because the State has to meet so many technical legal requirements to meet its burden of proof on traffic offenses. Before choosing to be a defense attorney, Leslie spent more than six years as a full-time municipal court judge in one of Georgia’s busiest courts, where approximately 80% of her work was handling traffic cases. Do I really need a lawyer for a traffic case?

If you want the best result, yes. Anyone can Google search questions about traffic law–or any law for that matter. But, the information out there is often completely wrong. More importantly, a Google search can’t negotiate with the prosecutor or try a traffic case. It’s the skill of knowing the law and being able to apply it to the facts of a particular case that makes a difference. It’s knowing the prosecutor, the judge, and the local court system. Lawyers get better results because they don’t just know the law. They know how to skillfully use the law to a Client’s advantage.

A nolo plea will keep points off my license and protect my driving history, right?

Not exactly. State law allows a driver convicted of a traffic offense to use a nolo contendere (no contest) plea once every five years to prevent points from being applied to the driver’s license for the offense. However, with many offenses which are “reportable” to the State, the nolo plea still goes on the driver’s driving history. What this means is that the nolo plea can be seen on your driving record, just like a guilty plea. If your insurance company pulls your driving history–which most often happens when you apply for or renew your insurance–they will see the nolo plea. So, they may still increase your insurance rates. Better than a nolo plea is to try to resolve the case with a “non-reportable” offense or a dismissal. I am a commercial driver and got a traffic citation, how can the citation affect me?

First, were you cited in the commercial vehicle or your personal vehicle? Many offenses are reportable in both instances, but only certain offenses will affect your commercial driver’s license as a “serious” or “major” disqualification. If reportable on your commercial driver’s license, the offense can affect your motor carrier service record, and can place points on your Federal Motor Carrier Services Administration (FMCSA) record. Many trucking companies review drivers’ FMCSA records to make hiring decisions.
