Not Guilty of Aggravated Assault on a Law Enforcement Officer, May 2023

Client was charged with aggravated assault on a law enforcement officer.

Through cross-examination of the State’s witnesses and closing arguments, Leslie showed the Jury that the officer’s claim that Client pointed a gun a him was bogus because radio traffic of the officer’s statements to dispatch showed the officer was unaware of the firearm until after Client was arrested.

Client, who had prior felony convictions, testified at trial. During his testimony, Client explained to the Jury he never pointed a gun at the officer, but he did commit some of the other crimes alleged in the indictment. Client explained his actions were the result of his drug addiction.

The Jury believed Client and acquitted him of assaulting the officer, found him guilty of the lesser crime of possession of methamphetamine instead of possession with intent to distribute meth, and also found him guilty of the other crimes he admitted.

Client went home the night he was sentenced with probation and credit-for-time served.
