Motion to Suppress Granted in Gang Case, January 2024

Leslie filed a motion to suppress writings the State claimed were unlawful “gang literature.” The State planned on using the evidence to attempt to prove Client’s involvement in and connection to a gang alleged to have been involved in a shooting.

Client was indicted for two gang violations, three aggravated assaults, three counts of possession of a firearm during the commission of a crime, and two other firearm possession counts—facing 130 possible years in prison.

The trial court granted the motion to suppress after Leslie’s cross-examination.

The granting of this motion prevented the State from using this evidence against Client, and the Client resolved the case without a trial.
